Journalist Sinan Aygül Sentenced to Prison for Insulting His Assaulters

Sinan Aygül, the President of the Bitlis Journalists Association, was attacked by the guards of Tatvan Mayor Mehmet Emin Geylani, who are also his relatives. Aygül has been sentenced to 2 months and 5 days in prison for insulting one of the attackers. Due to previous sentences received for his reports, recidivist provisions will be applied to the new sentences he has received. This means that Aygül will spend the entire duration of his sentence in a closed prison institution.

In Bitlis’ Tatvan district, on June 17, Sinan Aygül was attacked by Mehmet Emin Geylani’s police bodyguard Engin Kaplan and boxer bodyguard Yücel Baysal, who are also his relatives. Aygül was sentenced to 2 months and 5 days in prison for insulting Yücel Baysal, one of the attackers. According to MLSA, a report was prepared for Aygül, who was referred to the Council of Forensic Medicine as part of the assault case, stating that there was “no permanent scar on his face.”

The indictment prepared by the Tatvan Public Prosecutor’s Office for the ‘insult’ allegation was accepted by the Tatvan 1st Criminal Court of First Instance, and the trial was conducted under the simple trial procedure since the case fell under Article 251 of the Criminal Procedure Law (CMK).

In the trial held at the Tatvan 1st Criminal Court of First Instance, journalist Aygül was sentenced to 2 months and 5 days in prison. The court, which sentenced him for the crime of ‘insult,’ decided that the punishment should be served in accordance with the ‘recidivist’ provisions foreseen in Article 58 of the Turkish Penal Code. Recidivist provisions will be applied to the new sentences Aygül has received due to previous penalties for his reports.

This means that Aygül will spend the entire duration of his sentence in a closed prison institution. The decision stated that “the defendant’s criminal personality was taken into account,” and therefore, the sentence was not converted into a fine.

“I’ll be arrested because I didn’t die!” Aygül, talking about the extraordinary nature of the process as well as the nature of the attack, said that he received a penalty before the attackers and that he would be arrested for being attacked. Aygül commented on this matter: “I had said before that I would almost receive a penalty, be arrested for being attacked. I had said that a case could only be strained this much against one person, in favor of some people, it was strained. I had said that each development overshadows the previous scandal. What we said is coming true. The attackers are free, maybe they will receive a minor penalty, be reinstated, and terrorize again with clubs in their hands and the state’s guns on their waists. I, on the other hand, will go to prison for defending the public’s, the people’s interest. I will be incarcerated for not dying, for escaping death. The decision was given under the simple trial procedure, my lawyer objected, it will be tried with hearings. If it goes to hearings, the given reduction will be removed, and I will receive a prison sentence of 2 months and 27 days.”
