Turkey: Prosecutor’s Office Declines to Pursue Torture Claims in Police Custody

In the wake of July 15, following a series of ‘genocide’ investigations initiated by the AKP regime targeting alleged community members, Aysun Işınkaralar claimed she was subjected to torture while detained at the Afyonkarahisar Security Directorate. Despite her allegations of being hooded and electrocuted at the feet, the Afyonkarahisar Republic Prosecutor’s Office has declined to pursue the case, sparking criticism from politicians and human rights advocates.

On April 22, 2024, the Afyon Chief Prosecutor’s Office rejected Işınkaralar’s complaint against police officers who allegedly tortured her at the Afyon police headquarters. Işınkaralar, who was detained on May 7, 2018, for her role as director at the now-shuttered Özel Nezahet Girls’ Student Dormitory, had accused the officers of applying electric shocks to her ankles, choking, and making threats.

The decision not to prosecute cited that Işınkaralar’s statements lacked evidentiary value and were insufficient to warrant reopening an investigation. According to a report by Sevinç Özarslan from Kronos, the prosecutor’s ruling stated that despite claims from Işınkaralar about a falsified medical report and a subsequent human rights report confirming torture, these elements failed to meet the legal standards for evidence in criminal law.

Ömer Faruk Gergerlioğlu, a DEM Party MP from Kocaeli, vehemently criticized the prosecutor’s decision, highlighting the ongoing issue of unchecked abuses within the system. “Aysun Işınkaralar has bravely fought against the concealment of her torture by Afyon police for years,” Gergerlioğlu stated. “Despite clear evidence of torture, and systemic failures by those sworn to uphold justice, including doctors and prosecutors, her pleas for justice were dismissed.”

The Human Rights Foundation of Turkey has also documented claims of electric shocks, suffocation attempts, and harassment against Işınkaralar, supporting her allegations of mistreatment.

Her struggle for acknowledgment and justice continues, as the prosecutor’s dismissal of her case underscores the broader challenges faced by individuals alleging torture and abuse in custody in Turkey.
